Welcome to InterOptika. These Terms and Conditions (“Terms”) govern your use of the website at www.interoptika.co.za (“the Website”) and your purchase of any products (including prescription glasses, sunglasses, contact lenses, and accessories) from us.

By accessing or using the Website, placing an order, or utilizing our services, you agree to be bound by these Terms and Conditions, which comply with the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), the Consumer Protection Act 68 of 2008 (“CPA”), and the Protection of Personal Information Act 4 of 2013 (“POPIA”) of the Republic of South Africa.

1. DEFINITIONS AND INTERPRETATION

1.1. “Products” means all eyewear, optical frames, prescription lenses, contact lenses, sunglasses, and related accessories sold on the Website. 1.2. “Customer” / “You” means any person who uses the Website or purchases Products. 1.3. “Gauteng Collection Point” means our designated physical branch locations within Johannesburg, Gauteng, Republic of South Africa, solely for the purpose of collecting online orders. 1.4. “Registered Practitioner” means a registered Optometrist or Ophthalmologist registered with the Health Professions Council of South Africa (HPCSA).

2. SALE OF PRESCRIPTION PRODUCTS & CUSTOMER WARRANTIES

2.1. Prescription Requirement: By placing an order for prescription glasses or contact lenses, you warrant that you are 18 years of age or older and possess a valid, current prescription issued by a Registered Practitioner. 2.2. Prescription Validity: You confirm that your prescription is not older than twenty-four (24) months, or such shorter period as required by South African law or recommended by your Registered Practitioner. 2.3. Information Accuracy: You warrant that all prescription details, pupillary distance (PD) measurements, and personal details provided to us are accurate, true, and complete. 2.4. No Medical Advice: We are an online retailer and dispensing supplier, not a medical or optical practitioner. The information provided on this Website is not a substitute for a comprehensive eye examination. It is your sole responsibility to ensure you have had a recent eye examination and that your prescription is correct and suitable for the Products ordered. 2.5. Verification and Dispensing: You acknowledge that the final dispensing of prescription eyewear and contact lenses may be subject to internal verification checks by our qualified dispensing opticians to ensure compliance with your prescription and relevant regulatory standards (HPCSA/SAHPRA).

3. USE OF VIRTUAL AND AUGMENTED REALITY (AR/VR) FEATURES

3.1. Third-Party Technology: The Website may employ third-party plugins or applications, including virtual try-on (AR/VR) tools, to assist you in visualizing Products on your face. 3.2. Illustrative Purpose Only: You acknowledge that the AR/VR try-on is for illustrative and convenience purposes only and is not a substitute for physical fitting, measurement, or professional consultation. 3.3. Accuracy Disclaimer: Due to variations in screen calibration, lighting, image resolution, camera angles, and the inherent limitations of virtual technology, we cannot guarantee that the AR/VR feature will accurately reflect the colour, fit, size, position, or look of the product in person. 3.4. Risk: Your reliance on the accuracy of the fit, size, or appearance suggested by the AR/VR tools is entirely at your own risk. We strongly recommend cross-referencing virtual sizing with physical product dimensions.

4. PRODUCT INFORMATION AND BRANDING

4.1. Branded Goods: We specialize in selling branded Products. All branding is used with permission or sourced via authorized distributors. We guarantee the authenticity of the branded Products we supply. 4.2. Product Representation: We make every effort to display the Products accurately, including applicable manufacturer warranties. However, we do not warrant that the Product descriptions, colours, or information on the Website are wholly accurate, complete, or error-free.

5. PRICING, PAYMENT, AND ORDER ACCEPTANCE

5.1. Order Confirmation: Your submission of an order constitutes an offer to purchase the Products. We will confirm receipt of your order via email, but this does not constitute acceptance of your offer. 5.2. Acceptance: Acceptance of your order and the formation of a binding agreement of sale occurs when we dispatch the Products and send you a dispatch confirmation email. 5.3. Stock and Availability: All Products are subject to stock availability. In the event a Product is unavailable after payment, we will contact you to offer alternatives or a full refund. 5.4. Pricing Errors: Should a Product be listed at an incorrect price due to a system error or typographical mistake, we reserve the right to refuse or cancel any orders placed for the Product at the incorrect price, even if the order has been confirmed and payment processed. If your order is cancelled, we will issue a full refund immediately.

6. DELIVERY, RISK, AND COLLECTION

6.1. Delivery (National)

6.1.1. Delivery Time: Our estimated delivery turnaround time is between two (2) and five (5) working days from the date of order acceptance and payment verification. This is an estimate only and is subject to Product stock availability and courier service capacity. 6.1.2. Delays: We shall not be liable for any loss or damage caused by delays in delivery occasioned by stock shortages, force majeure, courier delays, or failure by you to provide accurate delivery information. 6.1.3. Risk: The risk of loss, theft, or damage to the Products transfers to you, the Customer, upon delivery of the Products to the physical address specified in your order.

6.2. In-Store Collection (Click & Collect)

6.2.1. Service Limitation: The In-Store Collection option is offered exclusively to residents of the Gauteng province due to our limited branch locations being situated in Johannesburg. 6.2.2. Collection Process: You will be notified via email when your order is ready for collection at the designated Gauteng Collection Point. Orders will be held for a maximum of seven (7) days unless alternative arrangements are made in writing. 6.2.3. Identification: You must present valid identification (South African ID or Driver’s License) and your order confirmation email when collecting your order.

7. RETURNS, EXCHANGES, AND REFUNDS

7.1. CPA Compliance: Our return and refund policy is in accordance with the CPA. 7.2. Defective Products: If a Product delivered to you is defective, we must be notified within six (6) months of delivery. We will arrange for collection of the item and, upon assessment, will offer a repair, replacement, or refund. 7.3. Change of Mind: Non-defective Products may be returned within seven (7) days of delivery or collection, provided they are unused, undamaged, and in their original, unopened packaging. Please note that custom-made prescription lenses and opened contact lenses may be subject to a restocking fee or may not be returnable if deemed used or customized. 7.4. Warranties: Products are covered by the original manufacturer’s warranty, which varies by brand. We will facilitate any valid warranty claims against the manufacturer or authorized distributor.

8. INTELLECTUAL PROPERTY

8.1. All content on the Website, including text, logos, product images, and software used for the AR/VR features (to the extent we own the licensing rights), is the property of [Your Company Name] or its suppliers and is protected by South African and international intellectual property laws. 8.2. You may not use, reproduce, or exploit any branded logos or product likenesses without the express written permission of the respective brand owner.

9. LIMITATION OF LIABILITY

9.1. 10.1. We are committed to protecting your privacy. Our collection, use, and storage of your personal information (including prescription details) is governed by our separate Privacy Policy, which is available on the Website and complies with POPIA.

11. GOVERNING LAW AND JURISDICTION

11.1. These Terms and Conditions shall be governed by the laws of the Republic of South Africa. 11.2. In the event of any dispute arising out of or in connection with these Terms, you consent to the jurisdiction of the Magistrate’s Court or the High Court of South Africa (Gauteng Local Division, Johannesburg), notwithstanding that the amount of the claim may exceed the jurisdiction of the Magistrate’s Court.
